The Delhi High Court has adopted a strict attitude in the matter of hoarding of medicine and oxygen cylinders. At the same time, the drug controller has held the Gautam Gambhir Foundation guilty in this case. On behalf of the drug controller, the court was told that 2349 strips of Fabiflu were purchased by the Gautam Gambhir Foundation. During the hearing of the case, the Drug Controller has also told in the High Court that in this case, a notice has been issued to the Gautam Gambhir Foundation, asking from where did he buy the medicines and whether he had taken permission from the licensing authority for this?
Advocate Nandita Rao, appearing for the Drug Control Department, submitted that the Gambhir Foundation procured 120 oxygen cylinders and were refilled by authorized dealers and distributed to various people under the supervision of Dr. Siddhartha. Medicines given free of cost by Gautam Gambhir Foundation were received by 1,139 patients. The Gautam Gambhir Foundation also did unauthorized stocking of FabiFlu, committing an offense under the Drugs and Cosmetics Act. Gautam Gambhir Foundation has violated the Drugs and Cosmetics Act by storing medicines.
