On this issue, the court has sought a reply from the government in two weeks. In fact, an NGO, PUCL, has filed a petition in the Supreme Court saying that police action is being taken against those who are expressing their views by commenting on social media. Especially in Uttar Pradesh, many cases have been registered and people are being sent to jail. Whereas in the year 2015, the Supreme Court of I.T. Section 66A of the Act was repealed. This decision means that every person has the right to express his opinion on social media. Commenting cannot be called an offence.
Advocate Sanjay Parikh told the court during the hearing on Monday that despite the decision to repeal the law, the police are registering cases against those who comment on social media and people are being sent to jail. On this, Justice RF Nariman, Justice KM Joseph and Justice BR Gavai said that ‘we know. The situation is shocking and shocking. In response, Attorney General KK Venugopal said that in the new IT Act, it is clearly written in the footnote that section 66A has been repealed. On this, Justice Nariman laughed and said that the SHO would not have read the footnotes.
