Court can’t assume that all death due to COVID 2nd wave is because of medical negligence

New Delhi, 8/9: The courts cannot assume that all deaths due to COVID-19 during the second wave of the global pandemic (Covid 19) were due to negligence. The court made the observation while refusing to entertain a petition seeking compensation to the kin of the deceased as medical negligence.

A bench of Justice Dhananjay Y Chandrachud, Justice Vikram Nath and Justice Hima Kohli asked petitioner Deepak Raj Singh to approach the competent authorities with his suggestions.

The bench said, “The belief that every death due to civid-19 was due to negligence is too much. The second wave had such an impact across the country that it cannot be assumed that all deaths were due to negligence. Courts cannot assume that all deaths due to COVID were due to medical negligence, as your petition holds.”
