New Delhi, 28/1: The Supreme Court has refused to dilute the conditions of reservation in promotion for Scheduled Castes and Scheduled Tribes. The court has said that the state is bound to collect quantitative data before granting reservation in promotion to SC/ST employees. The court has said that after the decision of the Constitution Bench in the case of Nagraj (2006) and Jarnail Singh (2018), the apex court cannot make any new parameters. In this case, the court had reserved its decision on 26 October 2021.
The Supreme Court has said that it is necessary to collect data on representation in high posts before reservation in promotion. At the same time, the court said that the representation should be evaluated within a stipulated period. The Supreme Court said that what will be the period, it should be decided by the Central Government. The hearing on clarity in the matters of reservation related to the Center / States will start from February 24.
A three-judge bench headed by Justice Nageswara Rao said that the states are bound to collect data on the inadequacy of representation of SC/ST. The apex court said that it cannot lay down any criteria to determine the inadequacy of representation of SC/ST. The state government can do this work.
