Orissa High Court slams misuse of Habeas Corpus Petition, fines husband ₹50,000

Cuttack, June 25: The Orissa High Court has come down heavily on the misuse of judicial processes for personal motives, observing that courts cannot be used as tools to exert pressure in private disputes. The court dismissed a habeas corpus petition filed by a husband seeking the return of his wife and imposed a penalty of ₹50,000 on him.The petitioner, Lakshmidhar Patra, had approached the High Court alleging that his wife was missing and sought directions for her production before the court. During the hearing, however, it emerged that the woman had voluntarily left her matrimonial home due to marital discord and was not under any illegal detention.A Division Bench comprising Chief Justice Harish Tandon and Justice M.S. Raman observed that an adult woman has the right to make decisions about her own life and cannot be treated as the property of her husband. The bench emphasized that there is a clear distinction between a person leaving home of her own free will and a case of abduction.The court further noted that a wife who does not wish to reside with her husband cannot be compelled by judicial intervention to return to the matrimonial home. It held that the petitioner had misused the constitutional remedy of habeas corpus and unnecessarily consumed valuable judicial time.Terming the petition an abuse of the legal process, the High Court imposed a fine of ₹50,000 on the petitioner and directed him to deposit the amount with the State Legal Services Authority within two weeks. The amount will be utilized for the welfare of juvenile delinquents.The ruling is being viewed as a significant reaffirmation of women’s autonomy and a strong warning against the misuse of legal remedies in matrimonial disputes.
